Terms and conditions of Hire

These terms and conditions apply to the hire of all items (Hired Items).
Definition of conditions.

1.1 Business Day - A day other than a Saturday, Sunday or Public Holiday in England.

1.2 charges - the charges payable by the Hirer for the supply of equipment in accordance with clause 8. As further detailed in these conditions.

1.3 Commencement Date - the first day of hire

1.4 Confirmation - written confirmation of the terms of hire.

1..5 Condtions - these terms and conditions, as amended from time to time.

1.6 Contract - The contract between the Company and the Hirer for the supply of Equipment as per the terms of these conditions.

1.7 Delivery Date - The date of delivery of the hired items. Or

1.8 Collection Date - The date of collection of the hired items

1.9 Hirer - The person or Firm who hires the Equipment from the Company.

1.10 Delivery Location - The delivery location as stated in the confirmation document or such other address as agreed between the Hirer and the Company

1.11 Equipment -The Equipment as supplied by the Owner to the Hirer as per the Confirmation.

1.12 Hire Period - the start and end dates of the period of hire

Basis of Contract

2.1 The contract constitutes an offer by the Hirer to hire the equipment from the Company in accordance with these conditions.

2.2 The contract shall be deemed to be accepted when the company issues written acceptance of the order (confirmation) detailing at which point and on which date the contract will come into existence (The commencement date).

2.3 Any samples, descriptions, illustrations and advertising issued by The Company on their website, brochures are for the sole purpose of giving the hirer an approximate idea of the Equipment for hire.This shall not form part of the contract.

2.4 Any quotation given by the Company shall not constitute an offer and is only valid for a period of 60 days from date of issue.

Supply of Equipment

3.1 The company shall supply the Equipment to the Hirer as detailed in the description on the Confirmation.

3.2 The Company shall have the right to make any changes to the Equipment which are necessary in order to comply with any applicable law or Safety requirement . The company shall use reasonable endeavours to notify the Hirer in any such event.

3.3 The Company shall promise to the Hirer that the Equipment will be provided using reasonable care and skill.

3.4 The props/Equipment will have signs of wear and tear and are supplied as seen. The hirer may inspect the props prior to placing an order by making a prior appointment to visit our warehouse by giving reasonable time and notice.

3.5 Props are designed for indoor use only unless we agree otherwise. 

3.4 All electrical props are for visual effect only and should not be used. If the hirer requires to use the items they should seek prior agreement from the Company after which the items will be PAT tested. PAT Testing certificates are available on request for a small fee.

3.5 The Company cannot be held responsible for the compatibility of the hired equipment if the hirer intends to use it in conjunction with other equipment. It is the hirers responsibility to check the compatibility beforehand.

Hirers Obligations.

The Hirer shall:

4.1 Ensure that the terms on the confirmation are correct and accurate.

4.2 Co Operate with the Company on all matters regarding the hire of the Equipment.

4.3 Provide the Company with the Name, address, phone number and email address of the Hirer.

4.4. Obtain and maintain all necessary licences, permissions and consents before entering into a Contract to hire the Equipment.

4.5 Keep and Maintain the Hired Goods at the Hirers premises in good safe condition at its own risk until returned to the Company and not to dispose of the equipment or use other than in accordance with the Companies written instructions or authorisation.

4.6 Must not paint, deface or change any Prop without prior consent from the Company in writing.

4.7 Ensure that the props are not abused, sat on, climbed on or using the prop for any other use than its intended use.

4.8 insure the equipment to the replacement value (ten times the hire fee) with a reputable company for the period of hire as per the dates quoted in the hire contract.

5. If the Companies performance of any of its obligations under the terms of the contract is prevented or delayed by any act of the Hirer the company shall

5.1 have the right to delay the hire period until the Hirer has remedied the default

5.2 the Company shall not be liable to any cost or losses arising from it not hiring the equipment in respect of 5.1

5.3 The Hirer shall reimburse the Company on written demand for any costs incurred or losses sustained by the Company arising directly or indirectly from the Hirers default.

Delivery and Collection of Equipment

6.1 The Equipment may be delivered and/or collected in the following ways.

6.1.1  The Company or its representatives shall deliver the Equipment to the delivery location or such other location as agreed at any time after the Company has confirmed to the Hirer that it is ready for delivery and will deliver on the agreed date as specified in the Contract. The Equipment will be made ready for collection by the Hirer on the agreed collection date.

6.1.2 The Hirer shall collect the Equipment from the Company’s Warehouse on the date as specified in the Contract and shall return the equipment to the warehouse on the agreed date.

Where the Company delivers the Equipment as per 6.1.1 above 

6.2.1 The Hirer is responsible for attending the delivery location to accept and sign for delivery of the Equipment.

6.2.2 On Delivery the Company reserves the right to refuse delivery if the Hirer is not present or the Equipment cannot be delivered to the delivery location as a result of obstacles in the delivery location.

6.2.3 The Hirer is responsible for checking that all deliveries of equipment match to order and 

6.2.4 on collection the Hirer is responsible for ensuring that all the Equipment is packed in the same condition as when it was delivered.

6.2.5 Penalty charges will be issued by the Company to the Hirer if the above terms are not adhered to. Charges will be advised to the hirer, however as a minimum a £150 inconvenience fee will be charged.

Where the Hirer collects the Equipment from the Company’s Warehouse and returns it as per 6.1.2

6.3.1 The Hirer shall collect/return the Equipment between the hours of 10.00am and 4.00pm Monday to Friday or outside of these hours by special arrangement.

6.3.2 The Hirer shall be responsible for unloading the Equipment at the delivery location.

6.3.3 The Hirer will be responsible for any damage caused during loading of equipment , transportation and any other damage caused during the hire period.

6.3.4 The Hirer is responsible for insuring the Equipment at all times whilst the Equipment is in transit and throughout the period of hire.

6.3.5 Upon return of the equipment the Hirer is responsible for ensuring that all equipment is packed in the same condition as when it was collected including all packaging materials and cases.

6.4 Any dates for delivery are approximate only. The company shall not be held responsible for any delay in delivery caused by Force Majeure Event or the Hirer’s failure to provide the Company with adequate delivery instructions or any other instructions that are relevant to supply of the equipment.

6.5 If the Company fails to deliver the equipment its liability shall be limited to the costs and expenses incurred by the Hirer paid to the Company and such costs will be reimbursed to the Hirer.

7.0 Ownership of the Items/Equipment remain the ownership of the Company and should be returned by the Hirer at the end of the hire period in the same condition as when it was rented out.

Charges and Payments

8. The charges for the hire of the equipment must be made prior to collection or delivery of the Equipment unless otherwise agreed between the Hirer and the Company.

8.1 Upon placing the order the Hirer will pay a 20% non refundable deposit to secure the booking.

8.2 A damage and loss deposit will also be payable at a rate of 50% of the hire cost and this will be returned to the Hirer on the safe return of the goods to the Company.

8.3 The Hirer will be responsible for the cost of any repair work if a fault is found due to the hirers neglect of the Equipment. The cost of such repair work shall be invoiced by the Company to the Hirer at any time after the completion of the Hire Period and payable by the Hirer within 7 days of the date of the invoice.
